Privilege-log a document production

A withheld document is not produced or silently dropped; it is logged with the taught fields before the production ships.

1. Identify each document withheld as privileged or work product.
2. Record date, authors, recipients, and the privilege claimed.
3. Describe the subject without revealing the privileged content.
4. Have counsel review the log.
5. Produce the non-privileged set.
6. Serve the log with that production.
7. Do not produce a privileged family member ‘to keep the email thread readable.’
