File an 83(b) election within 30 days

Practice the sequence you already learned for “File an 83(b) election within 30 days” until the order feels automatic. Drill IRC 83(b) from equity-compensation training. The election is not valid if it is mailed after day 30. A copy goes to the employer; it is not attached to the Form 1040.

  1. Confirm the grant is eligible and that you want to include the current value in income.
  2. Complete the 83(b) statement or Form 15620 with grant date, shares, and fair value.
  3. Mail it to the IRS within 30 days of the grant and keep proof of mailing.
  4. Provide a copy to the employer.
  5. Keep the proof of mailing and a copy of the election with your tax records.
  6. Do not wait for year-end tax prep to mail the election.
  7. Do not attach the election to the Form 1040; that requirement ended in 2016.
