Complete an NHPA Section 106 consultation

Practice the sequence you already learned for “Complete an NHPA Section 106 consultation” until the order feels automatic. Drill 36 CFR 800 from cultural-resources training. Ground disturbance is not authorized until identification, assessment, and consultation (or the agreement) are done.

  1. Confirm the action is an undertaking subject to Section 106.
  2. Define the area of potential effects.
  3. Identify historic properties in that APE.
  4. Assess adverse effects.
  5. Consult SHPO / THPO and other consulting parties.
  6. Resolve effects with an agreement if required.
  7. Do not start construction on a federal or federally funded project during an open 106.
